1. Acceptance of Terms

By browsing the website webixtan.com (the "Site") or requesting our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree, please discontinue using the Site and our services.

2. Description of Services

Webixtan is a digital studio specializing in custom web design, web development, UI/UX design, e-commerce solutions, and maintenance. Package descriptions, features, and pricing displayed on the Site are illustrative and subject to change; final technical specifications, project milestones, and total fees are confirmed via a project proposal or written service agreement.

3. Intellectual Property & Ownership

• Agency IP: Webixtan retains all intellectual property rights to its proprietary design systems, reusable framework components, internal tools, code templates, brand assets, and marketing materials displayed on this Site.
• Client Deliverables: Upon full and final settlement of all invoiced fees, copyright and ownership of the customized front-end design, project-specific code, and delivered digital assets are transferred to the client, unless otherwise agreed in writing.
• Third-Party Components: Third-party libraries, fonts, stock photography, or CMS platforms integrated into deliverables remain subject to their respective licenses.

4. Client Responsibilities & Project Timelines

Timely delivery depends on mutual cooperation. You agree to provide required assets (text copy, brand logos, high-resolution media, access credentials) in a timely manner. Webixtan cannot be held responsible for project delays caused by late content delivery, prolonged review cycles, or lack of client response.

5. Proposals, Pricing & Payment Terms

Submitting an inquiry or order form serves as a preliminary quote request. Work officially commences once terms are approved and the agreed upfront deposit (typically 40%–50%) is received. The remaining balance becomes due upon project sign-off or prior to live server deployment/code transfer. Payments are made via bank transfer (IBAN) as indicated on our invoices.

6. Revision Policy & Scope Creep

Each quote or package includes a defined number of revision cycles (typically 2 rounds) within the agreed design wireframe/mockup stage. Additional features, page additions, workflow redesigns, or changes requested after milestone approvals constitute "scope creep" and will be quoted and billed as an additional phase.

7. Warranty, Bug Fixes & Maintenance

We provide a 30-day post-launch warranty period during which bugs directly attributable to our custom development will be corrected free of charge. This warranty excludes defects caused by third-party hosting failures, client alterations to the source code, unauthorized plugin updates, or external API modifications.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Webixtan, its directors, and contractors shall not be liable for any indirect, consequential, punitive, or loss-of-profit damages arising from website downtime, security incidents outside our direct infrastructure control, or search engine ranking changes.

9. Confidentiality

Both parties agree to treat all business strategies, client records, and technical documentation shared during the project as strictly confidential, using them solely for the execution of the agreed services.

10. Cancellation & Termination

Either party may terminate a project upon written notice if the other party breaches these terms. If a project is cancelled by the client after work has commenced, the upfront deposit will be retained to cover labor and operational costs incurred up to that date.

11. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Turkey. Any legal disputes arising out of these terms shall be subject to the exclusive jurisdiction of the Courts and Enforcement Offices of Istanbul.
